Many family cases in Ms. Michalczyk's office are settled prior to any Court intervention: there are no winners in matrimonial or family litigation. Ms. Michalczyk attempts to achieve a just resolution for her clients, and settle disputes before court intervention is required. Court intervention is extremely costly due to the nature of the legal system, and Ms. Michalczyk believes that it is in the family's best interest to try to resolve the matter through bargaining outside of the court room. However, if there is no alternative besides going to trial, Ms. Michalczyk will be prepared to fight for you. Ms. Michalczyk will always have your best interest in mind when going to court on your behalf. Though bargaining outside court is the preferred method, sometimes court intervention is required. That's why Ms. Michalczyk has the following motto: "Prepare your case as if you are trying it, and hopefully you will not have to."
Successful appellate work of Ms. Michalczyk involve issues of divorce, bankruptcy, equitable interest in the marital residence, distribution of assets, the right to be heard, health insurance for the children, vacatur of income executions, allegations of negligence and malpractice in the context of performance of legal services, res judicata, proper parties in interest to maintain claims or counterclaims, necessary parties [CPLR 1001 (a)], summary judgment and dismissal of counterclaims.
